These Terms & Conditions ("Terms") govern your use of inthe99th.com (the "Site") and your booking of tutoring services with David de Koos, doing business as In The 99th ("we," "us," "our"). By using the Site or booking a session, you agree to these Terms. 1. Our services
We provide one-on-one and small-group ("cohort") tutoring and coaching for the GMAT, GRE, and SAT, including a free 30-minute trial session for prospective students. Services are delivered online [confirm platform, e.g. Zoom] unless otherwise agreed.
2. Booking & scheduling
Sessions are booked by submitting the contact form on the Site, after which we will follow up to confirm a time. Package hours and cohort seats are reserved on a first-come, first-served basis. [Add your scheduling tool/calendar link here if you adopt one.]
3. Fees & payment
Current rates are listed on the Site's Pricing section and are subject to change; the rate confirmed at the time of booking applies to that booking. 4. Cancellations & rescheduling

5. Cohort coaching
Cohort coaching sessions are contingent on minimum enrollment (currently at least 4 students) and a cohort will only begin once that minimum is met. If a cohort does not reach minimum enrollment, we will offer enrolled students a full refund, a transfer to a future cohort, or an equivalent number of 1:1 hours, at the student's choice.
6. No guarantee of results
David de Koos's own test scores, tutoring experience, and prior student outcomes are described on the Site for informational purposes. Individual results depend on many factors outside our control, including a student's starting point, effort, and study time, and we do not guarantee any specific score, score improvement, or admissions outcome.
7. Acceptable use
You agree to provide accurate information when contacting us or booking a session, and not to use the Site or contact form to send spam, unlawful content, or attempt to disrupt the Site.
8. Intellectual property
All content on the Site, including text, video tips, and coaching materials provided during sessions, is the property of In The 99th / David de Koos unless otherwise noted, and may not be copied, redistributed, or resold without our written permission.
9. Third-party links & tools
The Site may link to or rely on third-party services, including Netlify (form processing) and Google Analytics (site analytics), whose own terms and privacy policies also apply. See our Privacy Policy and Cookie Policy for details.
10. Limitation of liability
To the fullest extent permitted by law, In The 99th and David de Koos will not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or our tutoring services, including any admissions or scholarship decisions. Our total liability for any claim relating to our services is limited to the amount you paid for the specific session(s) giving rise to the claim.
